An application that seeks to modify the Horizontal Property Law in Spain in order to establish as mandatory and without conditions the realization of accessibility works for people with disabilities in said properties.
The request was made by the Spanish Committee of Representatives of Persons with Disabilities (CERMI) and addressed to the Ministry of Public Works that is currently processing the draft Law on Urban Rehabilitation, Regeneration and Renewal.
According to cermi's request, accessibility should be an issue that is addressed with the same legal seriousness and mandatory nature for the community, as well as the issue of building safety.
The current regulations do not treat people with special conditions equally, since the regulation only has a scope that is limited by the economic factor. Therefore, the Committee's request proposes that this standard be mandatory and that regardless of the cost, accessibility works be carried out in those buildings that are subject to the horizontal property regime in which people with disabilities or over 70 years of age live.
According to the Committee, the current law seriously violates the rights of people with physical and motor disabilities by limiting their free movement and to enjoy decent housing, which are all the reasons to implement the reform.
