The most recent labor reform in Mexico brought several significant changes, especially in terms of the issue of outsourcing services or what is known as REPSE, Registry of Specialized Service Providers or Specialized Works.

Specifically, Article 15 of the Federal Labor Law establishes that "natural or legal persons who provide specialized services or execute specialized works must have a registration with the Ministry of Labor and Social Welfare, by which they will demonstrate their specialized nature and that they are up to date with the tax obligations in terms of labor subcontracting."
Broadly speaking, the main objective of this regulation is to guarantee the quality and safety of the services provided in this sector, as well as to promote transparency and legality in operations.
The REPSE regulation impacts the Facility Management and Occupational Safety areas of companies by establishing standards and requirements for the provision of specialized services or Facility Services, such as facilities and remodeling, dining room services, cleaning, maintenance, gardening, surveillance or security, among others.
Failure to comply with REPSE regulations can have negative consequences, such as fines in labor, social security and Infonavit matters, as well as penalties in tax matters, both for the beneficiary and for the service provider.
As stipulated in the Public Registry of Companies and Specialized Services (REPSE), companies that contract specialized services or works must ensure that the contractor is duly registered in said system. This involves requesting documentation from the contractor that proves its registration and keeping this documentation for a period of five years.
